Regulation 2016\/679 (April 27 2016) of the European Parliament and of the Council (EU) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95\/46\/EC (General Data Protection Regulation)<\/span><\/p>\n

Scope and approval of the GTC<\/b><\/span><\/p>\n

The content of the agreement between us, in addition to the provisions of the applicable binding legal acts, is governed\u00a0by these General Terms and Conditions (hereinafter “GTC”)\u00a0. Accordingly, these GTC contain your\u00a0and our rights and obligations with respect\u00a0to you and us, the terms and conditions of the contract, the performance dates, the\u00a0delivery and payment terms, the liability rules, and the\u00a0conditions\u00a0for exercising the right of withdrawal\u00a0.<\/span><\/p>\n

The technical information required to use the Website, which is not\u00a0included in these\u00a0GTC, is provided by other information available on the Website.<\/span><\/p>\n

You must familiarize yourself with the provisions of these GTC before finalizing your order. By\u00a0purchasing through our\u00a0webshop, you accept the terms of this GTC and are\u00a0fully part of the agreement between you and the Seller.<\/span><\/p>\n

The language of the contract, the form of the contract<\/b><\/span><\/p>\n

The language of contracts subject to these GTC shall be Hungarian.<\/span><\/p>\n

Contracts covered by these GTCs shall not be considered as written contracts and\u00a0shall be registered by the Seller.<\/span><\/p>\n

Prices<\/b><\/span><\/p>\n

Prices are in\u00a0the currency of your choice\u00a0and include 27%\u00a0VAT\u00a0. The prices are informative. It is not\u00a0excluded that the Seller may change prices for business reasons. Price\u00a0modifications do not apply to contracts already concluded. If the Seller\u00a0has misrepresented the price, he shall\u00a0proceed in\u00a0accordance\u00a0with the\u00a0\u201cProcedure with a Defective Price\u201d of the GTC for contracts already concluded\u00a0.<\/span><\/p>\n

Complaint handling and redress<\/b><\/span><\/p>\n

The consumer\u00a0may communicate the complaint to the Company orally or in writing. <\/b>The complaint may relate to the\u00a0behavior, act or omission of the company or a person acting on behalf or for the benefit of the consumer goods business\u00a0that are directly related to the distribution or selling\u00a0of the goods.<\/span><\/p>\n

Verbal complaints must be promptly investigated by the business and\u00a0remedied as\u00a0necessary\u00a0<\/b>. If the consumer is not satisfied with the handling of the complaint or the immediate complaint\u00a0investigation is not possible, the business must record the complaint immediately and forward a copy to the consumer on site in. In the case of an oral complaint made by\u00a0telephone or other\u00a0electronic communications service, the minutes shall be sent to the\u00a0consumer along with a substantive\u00a0reply, in\u00a0accordance with\u00a0the\u00a0rules governing\u00a0the reply to a written complaint, no later than 30 days. Otherwise, written complaints shall be handled as follows. Unless otherwise\u00a0provided in\u00a0the directly applicable legal act of the European Union,\u00a0the\u00a0Company\u00a0must\u00a0reply in\u00a0writing within thirty days of\u00a0<\/b>receipt of the\u00a0written complaint\u00a0and take action to communicate it in\u00a0writing\u00a0<\/b>. A shorter deadline\u00a0may be\u00a0set by legislation and a\u00a0longer deadline may be set by law. In case the Company rejects the complaint, it needs to give a reasoned explanation. A\u00a0business must provide a unique identification number for verbal complaints made by\u00a0telephone or electronic communications services\u00a0.<\/span><\/p>\n

The minutes of the complaint shall contain:<\/span><\/p>\n

1. the consumer’s name and address,<\/span><\/p>\n

2. the place, time and means of filing the complaint,<\/span><\/p>\n

3. a detailed description of the consumer’s complaint, a\u00a0list of\u00a0the documents and other evidence\u00a0which the consumer has presented,<\/span><\/p>\n

4. a statement by the business regarding its position on the consumer’s complaint,\u00a0where the complaint can be promptly investigated,<\/span><\/p>\n

5. the\u00a0signature of the\u00a0person recording the report and,\u00a0except for oral\u00a0communication by telephone or other electronic communications\u00a0service, of the consumer,<\/span><\/p>\n

6. place and date of record,<\/span><\/p>\n

7. in the\u00a0case of a\u00a0verbal\u00a0complaint made by\u00a0telephone or other electronic communications service\u00a0, the unique identifier of the complaint.<\/span><\/p>\n

The Company shall\u00a0keep\u00a0a record of the complaint and a copy of the reply for a period of five years\u00a0and shall make it available to the control authorities on request.<\/span><\/p>\n

In the event of a complaint being rejected, the business shall inform the consumer in writing about which authority or the arbitration body the consumer may turn to (depending on\u00a0the nature of the complaint) to initiate\u00a0proceedings. The information shall also include the\u00a0location, telephone and\u00a0internet contact details and the postal address\u00a0of the competent authority\u00a0or of the conciliation body where\u00a0the\u00a0consumer is domiciled or resident. The information shall also include\u00a0whether the business uses an arbitration\u00a0procedure to\u00a0resolve a consumer dispute\u00a0.<\/span><\/p>\n

In the event that any consumer dispute between Seller and consumer is\u00a0not resolved during\u00a0the\u00a0negotiations, the following remedies are open to the\u00a0consumer:<\/span><\/p>\n

Complaint to\u00a0Consumer Protection Authorities.<\/b> If the consumer\u00a0discovers a breach of his\u00a0consumer rights, he has the right to complain to the consumer protection\u00a0authority in\u00a0his place of residence. After considering the complaint, the authority will decide on the consumer protection procedure. The first-level consumer protection duties are performed by\u00a0the district offices competent for\u00a0the consumer’s place of residence, a list of which can be found at:\u00a0http:\/\/jarasinfo.gov.hu\/<\/span><\/p>\n

Legal proceedings.<\/b> Customer is entitled to a court action to\u00a0enforce\u00a0a consumer claim in a\u00a0civil proceeding under Act V of 2013 on the Civil Code\u00a0and Act CXXX of 2016 on the Code of Civil Procedure.<\/span><\/p>\n

Please be advised that you may file a consumer complaint against us. If your\u00a0consumer complaint is rejected, you also have the right to apply to the\u00a0Arbitration Body competent in\u00a0your place of residence or domicile: the initiation of the arbitration body procedure is\u00a0subject to the consumer’s direct attempt to\u00a0resolve\u00a0the dispute with the business concerned\u00a0. At the request of the consumer, the procedure shall be replaced by\u00a0the conciliation body indicated in the consumer’s request\u00a0instead of\u00a0the\u00a0competent body.<\/span><\/p>\n

The Company shall be subject to the duty of cooperation in conciliation proceedings.<\/span><\/p>\n

This includes the\u00a0obligation\u00a0<\/b>for companies to\u00a0send a\u00a0response\u00a0to the\u00a0<\/b>invitation of the conciliation body\u00a0and the obligation to\u00a0appear\u00a0<\/b>before\u00a0the conciliation body\u00a0(”\u00a0ensuring\u00a0the presence of the\u00a0person\u00a0authorized to enter into a hearing\u00a0“).<\/span><\/p>\n

Where the business or seat of the business is not established in\u00a0the county in which\u00a0the Chamber operating\u00a0the territorially competent\u00a0conciliation\u00a0body is located, the business’\u00a0obligation to\u00a0cooperate\u00a0shall include\u00a0offering the\u00a0possibility of a written settlement in accordance with the consumer’s requirements. <\/span><\/p>\n

In case of a breach of the duty to cooperate the consumer protection authority\u00a0has jurisdiction, on the basis of which, as a result of legislative changes, mandatory fines\u00a0are <\/b>applicable for businesses\u00a0with unlawful conduct. It\u00a0is not possible to refrain from fines. In addition to the Consumer Protection Act, the\u00a0relevant provision of\u00a0the\u00a0Small and Medium-sized Enterprises Act has also been amended so\u00a0that no fine can be avoided in the case of\u00a0small and\u00a0medium-sized enterprises.<\/span><\/p>\n

For small and medium-sized enterprises, the fine may range from HUF 15,000 to HUF 500,000,\u00a0while for\u00a0non-small and medium-sized enterprises\u00a0subject to the Accounting Act with annual net\u00a0sales\u00a0exceeding HUF 100 million,\u00a0the fine may be up to 5% of\u00a0the\u00a0annual net sales of\u00a0the enterprise\u00a0with a maximum fine of HUF 500 million. By\u00a0imposing a\u00a0mandatory fine, the legislator\u00a0seeks\u00a0to emphasize the obligation of cooperation with conciliation bodies\u00a0and to ensure the active involvement of businesses in the conciliation proceedings.<\/span><\/p>\n

The conciliation body is competent for the out-of-court\u00a0settlement of\u00a0consumer disputes. It is the task of the conciliation body to attempt\u00a0to reach a settlement between the parties for the purpose of\u00a0resolving consumer disputes, failing which it will\u00a0decide on the\u00a0matter in\u00a0order\u00a0to\u00a0ensure the\u00a0simple, expeditious, effective and cost-effective enforcement of consumer rights. At the request of the consumer or the business, the conciliation body shall advise on\u00a0the rights and obligations of the consumer.<\/span><\/p>\n

Proceedings of the conciliation body shall be initiated at the request of the consumer. The request\u00a0shall be made in writing to\u00a0the chairman of the conciliation board: the requirement of written form may be fulfilled by letter, telegram, telegraph or\u00a0telefax,\u00a0or\u00a0by any other means that\u00a0enables the recipient to retain the data addressed to him for an appropriate period of time, and displaying stored data in unchanged form and content.<\/span><\/p>\n

The application must include<\/span><\/p>\n

a.\u00a0the consumer’s name, place of residence or place of stay,<\/span><\/p>\n

b.\u00a0the name, registered office or place of business of the businesses involved in a consumer dispute,<\/span><\/p>\n

c.\u00a0body requested by the consumer in place of the competent conciliation body, if applicable<\/span><\/p>\n

d.\u00a0a brief description of the consumer’s position, the facts supporting it and the\u00a0evidence therefor,<\/span><\/p>\n

e.\u00a0a statement by the consumer that the consumer has directly\u00a0attempted to resolve the dispute with\u00a0the business concerned<\/span><\/p>\n

f.\u00a0a statement by the consumer that no other conciliation body has taken action in the matter, no mediation has\u00a0been initiated, no claim\u00a0has been made or no\u00a0request\u00a0for payment\u00a0has been made,<\/span><\/p>\n

g.\u00a0motion for a decision of the Board,<\/span><\/p>\n

h.\u00a0the signature of the consumer.<\/span><\/p>\n

The application shall be accompanied by the document or a copy (extract) of the\u00a0document the content of\u00a0which\u00a0the consumer refers to as evidence, in particular a written\u00a0statement of the\u00a0business\u00a0rejecting the complaint or, failing that, any other\u00a0written evidence\u00a0available to the consumer\u00a0to prove that conciliation had been attempted.<\/span><\/p>\n

If the consumer acts through an agent, the application shall be accompanied by the power of attorney.<\/span><\/p>\n

Unless otherwise specified by Seller, Hungarian\u00a0VAT\u00a0will\u00a0apply\u00a0to all Products. According to these GTC, the Buyer may exercise his \/ her rights of enforcement.<\/span><\/p>\n

When using e-payment solutions payment shall be realized in the currency determined by the Seller. \u00a0Seller may withhold the product transfer until seller makes sure that the product\u00a0and delivery charges have been paid successfully and completely using electronic\u00a0payment solutions (including the case also when the\u00a0buyer\u00a0pays\u00a0the purchase price (shipping fee) in the currency of the Member State of the buyer\u00a0and the\u00a0seller does not receive the full amount of the\u00a0purchase price\u00a0due to\u00a0the\u00a0conversion and bank charges). If the Buyer may request delivery of the Product to the territory of Hungary\u00a0or to any other Member State of the European Union in accordance with\u00a0the\u00a0GTC,\u00a0the non-Hungarian customer\u00a0may also\u00a0request\u00a0it by any means of\u00a0transport indicated in\u00a0the\u00a0GTC\u00a0.<\/span><\/p>\n

If the Buyer has the right to choose to receive the Product personally from the Seller in accordance with the GTC,\u00a0then the non-Hungarian buyer can use it.<\/span><\/p>\n

Otherwise, the Buyer may request that the Product be shipped\u00a0abroad\u00a0at its own expense\u00a0. Hungarian customers are not entitled to this right.<\/span><\/p>\n

The Seller will fulfill the order after payment of the delivery fee, if the Buyer\u00a0fails to pay\u00a0the\u00a0delivery fee to the Seller or fails to resolve the delivery in independently of Seller, the Seller will terminate the contract and\u00a0refund\u00a0the paid purchase price\u00a0to the Buyer.<\/span><\/p>\n

Consumer information in accordance with Government Decree 45\/2014.\u00a0(II. 26.)<\/b><\/span><\/p>\n

Information on the consumer’s right of withdrawal<\/b><\/span><\/p>\n

Point 3 of Paragraph 1 of Section 8:1.of the Civil Code states that only\u00a0natural persons acting outside the scope of\u00a0their profession, self-employment\u00a0or business activity\u00a0qualify as consumers, therefore, legal entities cannot\u00a0<\/b>exercise\u00a0the right of withdrawal without justification!<\/b><\/span><\/p>\n

In accordance with Section 20 of Government Decree 45\/2014.\u00a0(II. 26.) consumers are entitled to the right of withdrawal without justification. The consumer may exercise the right of withdrawal <\/span><\/p>\n

(a) in the\u00a0case of\u00a0a contract for the sale of a product within 14 days of <\/span><\/p>\n

(aa\u00a0) the receipt of the product,<\/span><\/p>\n

(ab) or in the case of the sale of several products, where different products are supplied at different times,\u00a0within 14 days of the date of\u00a0receipt of\u00a0the last product, by\u00a0the consumer or a third party other than the carrier delegated by the consumer.<\/span><\/p>\n

Nothing in this paragraph shall affect the consumer’s right to exercise the\u00a0right of withdrawal\u00a0specified in this paragraph\u00a0between the date of conclusion of the contract and the date of receipt of the product.<\/span><\/p>\n

If the consumer has made an offer for the conclusion\u00a0of\u00a0the contract, the consumer shall have the\u00a0right to withdraw the offer before\u00a0the conclusion\u00a0of the contract, which shall terminate the binding\u00a0obligation to\u00a0conclude the contract.<\/span><\/p>\n

Notice of withdrawal,\u00a0exercise of\u00a0the consumer’s\u00a0right\u00a0of withdrawal or cancellation<\/b><\/span><\/p>\n

The consumer may exercise his right provided by Section 20 of Government Decree 45\/2014 (February 26) by an unequivocal statement or via the statement template that can be downloaded from the website.<\/span><\/p>\n

Validity of the consumer’s withdrawal statement<\/b><\/span><\/p>\n

The right of withdrawal shall be deemed to be exercised within the time limit if the consumer\u00a0submits\u00a0the\u00a0declaration within the time limit. The deadline is 14 days.<\/span><\/p>\n

It shall be for the consumer to prove that he has\u00a0exercised his\u00a0right of withdrawal in accordance with this provision\u00a0.<\/span><\/p>\n

The Seller is obliged to\u00a0confirm\u00a0the consumer’s notice of withdrawal\u00a0immediately\u00a0upon its receipt by electronic means, provided that it also guarantees the\u00a0consumer the exercise of the right of withdrawal\u00a0on its website.<\/span><\/p>\n

Obligations of the Seller in the event of consumer’s withdrawal<\/b><\/span><\/p>\n

Seller’s Refund Obligation<\/b><\/span><\/p>\n

If the consumer pursuant to Section 22 of Government Decree 45\/2014 (February 26) withdraws from the contract,\u00a0the Seller shall, within fourteen days of becoming aware of the withdrawal\u00a0will refund the total amount paid by the consumer for remuneration, including\u00a0expenses incurred in the execution context, such as shipping charges. Please note\u00a0that this provision does not apply\u00a0to extra costs incurred by choosing a\u00a0mode\u00a0other than\u00a0the least costly mode\u00a0of transport.<\/span><\/p>\n

Method of Seller’s Refund Obligation<\/b><\/span><\/p>\n

For\u00a0the event of a proper cancellation or termination in accordance with Section 22 of Government Decree 45\/2014 (February 26) Seller shall reimburse the amount to Buyer via the same payment method used by the Buyer to pay the amount to Seller. Subject to the consumer’s express consent, the Seller\u00a0may use\u00a0another\u00a0form of payment for\u00a0the refund, but shall not\u00a0charge\u00a0the consumer any additional fee. The\u00a0Seller shall not be liable for any delay due to the\u00a0Customer’s incorrectly and \/ or inaccurately entered bank account or\u00a0postal address.<\/span><\/p>\n

Extra Costs<\/b><\/span><\/p>\n

If the consumer expressly\u00a0opts for a\u00a0mode of\u00a0transport\u00a0other than the least expensive standard\u00a0, the Seller shall not be obliged to reimburse the resulting\u00a0additional costs. In this case, we are responsible for the refund up to the general shipping rates shown\u00a0.<\/span><\/p>\n

Right of retention<\/b><\/span><\/p>\n

The Seller may withhold the refund until the consumer has\u00a0returned\u00a0the\u00a0product or has unequivocally proved that it has been returned;\u00a0the\u00a0earlier of\u00a0the\u00a0two shall be taken into account. We\u00a0are unable to accept\u00a0C.O.D. or postpaid postal delivery.<\/span><\/p>\n

Consumer’s obligations in the event of termination or cancellation<\/b><\/span><\/p>\n

Returning the Product<\/b><\/span><\/p>\n

If the consumer has\u00a0withdrawn from the contract in accordance to Section 22 of Government Decree 45\/2014 (February 26) consumer return the product to the Seller or to a person authorized by the Seller without delay but not later than within fourteen days from the date of notification of the withdrawal. Returns are deemed completed on time if the\u00a0consumer dispatches the product before the time limit expires.<\/span><\/p>\n

The cost of returning the product<\/b><\/span><\/p>\n

The consumer shall bear the cost of returning the product. The product must be\u00a0returned to\u00a0the Seller’s address\u00a0. If the consumer terminates the off-premises\u00a0contract for the provision of a service\u00a0after commencement of the performance, he shall be required to pay to the\u00a0business a fee commensurate\u00a0with the service rendered up to the\u00a0time\u00a0the\u00a0notice is\u00a0given. The amount payable by the consumer shall be determined based on the total amount of the\u00a0contract, plus tax. Where the consumer proves that the total amount so determined is excessive, the proportionate amount\u00a0shall be calculated on the basis of the market value of the\u00a0services provided up to the date of termination of the contract. Please note that\u00a0we are unable to accept\u00a0C.O.D. or postpaid postal delivery.<\/span><\/p>\n

Consumer’s responsibility for depreciation<\/b><\/span><\/p>\n

The consumer shall be liable for\u00a0any diminution in use resulting from use in excess of\u00a0that\u00a0necessary\u00a0to determine\u00a0the\u00a0nature, characteristics and functioning of the product.<\/span><\/p>\n

The right of withdrawal cannot be exercised in the following cases<\/b><\/span><\/p>\n

The Seller expressly draws your attention to the fact that you may not exercise your right of withdrawal\u00a0in cases listed in Paragraph (1) of Section 29 of Government Decree 45\/2014 (February 26):<\/span><\/p>\n

(a) a contract for the provision of a service, after the performance of the service as a whole, where the service provider began with the consumer’s express prior consent, and the consumer has acknowledged that he will lose his right of withdrawal;<\/span><\/p>\n

(b) <\/i>a product or service whose price or charge is\u00a0beyond the control of\u00a0the business, and is subject to the\u00a0possibility of fluctuations even during the period provided for the\u00a0exercise of the right of withdrawal;<\/span><\/p>\n

(c) <\/i>a non-prefabricated product which has been manufactured following consumer’s\u00a0instructions or at the\u00a0express request of\u00a0the consumer, or which is clearly\u00a0personalized\u00a0to the\u00a0consumer;<\/span><\/p>\n

(d)\u00a0<\/i>perishable products or product with a short expiration period;<\/span><\/p>\n

(e)<\/i> sealed product which\u00a0cannot be returned after opening\u00a0for health or hygiene reasons;<\/span><\/p>\n

(f) <\/i>a product which, by its nature, is inextricably linked to\u00a0another product\u00a0after its transfer\u00a0;<\/span><\/p>\n

(g)\u00a0<\/i>alcoholic beverages the actual value of which\u00a0depends on market fluctuations\u00a0beyond the\u00a0control\u00a0of the business, the price of which was\u00a0agreed by\u00a0the parties at\u00a0the\u00a0time of\u00a0the\u00a0conclusion of\u00a0the contract\u00a0of sale\u00a0but which is not performed until\u00a030 days after the date of conclusion;<\/span><\/p>\n

(h) <\/i>a business contract where the business, at the express request of the consumer, meets the consumer to carry out urgent repair or maintenance work;<\/span><\/p>\n

(i)\u00a0<\/i>the sale or\u00a0purchase of\u00a0sealed audio or video recordings and computer software in\u00a0cases where, after delivery, the consumer has opened the packaging;<\/span><\/p>\n

(j)\u00a0<\/i>newspapers, magazines and periodicals other than subscription contracts;<\/span><\/p>\n

(k) for\u00a0<\/i>contracts awarded at public auction;<\/span><\/p>\n

(l)\u00a0<\/i>a contract for the provision of accommodation, transport,\u00a0car rental, catering or leisure\u00a0services, other than residential services\u00a0, where the performance\u00a0date or time limit\u00a0specified in the contract is fixed;<\/span><\/p>\n

(m) <\/i>digital content supplied on a intangible medium, where the business\u00a0has begun performance with\u00a0the\u00a0consumer’s express prior consent, and the consumer\u00a0has at the same time made a declaration to the effect that\u00a0he will lose his right of withdrawal.<\/span><\/p>\n

Accessory Warranty, Product Warranty, Guarantee<\/b><\/span><\/p>\n

This section of the Consumer Information is\u00a0based on the authorization in Paragraph (3) of\u00a0Section of\u00a0Government Decree 45\/2014 (February 26) applying Annex 3 to Government Decree 45\/2014 (February 26).<\/span><\/p>\n

Accessory Warranty<\/b><\/span><\/p>\n

When can you use your accessory warranty right?<\/b><\/span><\/p>\n

You may\u00a0enforce an accessory\u00a0warranty claim against the Seller in the event of the Seller’s defective performance under the\u00a0terms of the Civil Code.<\/span><\/p>\n

What rights do you have under your accessory warranty claim?<\/b><\/span><\/p>\n

You have the following accessory warranty claims options:<\/span><\/p>\n

You may request repair or replacement, unless\u00a0fulfillment\u00a0of the claim you have selected is\u00a0impossible or\u00a0would result in\u00a0disproportionate\u00a0additional costs\u00a0for Seller to meet your other claim. If you did not or could not request a repair or replacement, you\u00a0may request a pro-rata reduction of the service\u00a0, or\u00a0you may\u00a0repair\u00a0the defect at the Seller’s expense\u00a0, or you may terminate the contract.<\/span><\/p>\n

You may also revert to another accessory warranty right from the one you selected, but you shall bear the cost of the transition, unless it was justified or the Seller made the change necessary.<\/span><\/p>\n

What is the deadline for your accessory warranty claim?<\/b><\/span><\/p>\n

You are required to notify the Seller of the defect immediately, but no later than\u00a0two months after\u00a0the\u00a0discovery of\u00a0the defect. However, please note that\u00a0you will\u00a0no longer be able to enforce your\u00a0accessory warranty coverage beyond the two-year limitation period for\u00a0this\u00a0contract.<\/span><\/p>\n

If the subject-matter of the contract between the consumer and the business is second-hand, the parties may agree to a shorter\u00a0limitation period;\u00a0in this case, a limitation period of less than one year\u00a0cannot be validly imposed.<\/span><\/p>\n

Against whom can you enforce your accessory warranty claim?<\/b><\/span><\/p>\n

You may enforce your accessory warranty claim against the Seller.<\/span><\/p>\n

What are the other conditions to enforce your accessory warranty claims?<\/b><\/span><\/p>\n

Within six months of the date of delivery, besides communicating the defect there is no other condition\u00a0for enforcing your accessory warranty, if you can certify that the product or service was provided by\u00a0Seller. However, after six months have passed from the date of performance, it is your responsibility to\u00a0prove that the defect you discovered was present at the time of performance.<\/span><\/p>\n

By default,\u00a0warranty and warranty rights\u00a0for used products are different from the general rules. Defective performance may occur in the case of used products,\u00a0however,\u00a0the circumstances under which the Customer may\u00a0have expected\u00a0certain\u00a0defects must be taken into account. As a result of obsolescence, the occurrence of\u00a0certain defects becomes\u00a0more frequent, which means that used products cannot be expected to have the same quality as a newly purchased\u00a0product\u00a0would. Based on this Buyer can only exercise the warranty rights for deficiencies arising from defects other than the ones that occur due to obsolescence. If the used\u00a0product is defective and the Buyer who qualifies as is a Consumer, has been informed thereof at the time of purchase,\u00a0the Service Provider shall not be liable for\u00a0the\u00a0known defect.<\/span><\/p>\n

Product warranties<\/b><\/span><\/p>\n

When can you exercise your product warranty rights?<\/b><\/span><\/p>\n

In the event of a defect in a movable item (product), you may, depending on your choice, file an accessory warranty claim or a product warranty claim\u00a0.<\/span><\/p>\n

What are your rights under your product warranty claim?<\/b><\/span><\/p>\n

A product warranty\u00a0claim only allows you to request the\u00a0repair or replacement of the defective product.<\/span><\/p>\n

When is a Product defective?<\/b><\/span><\/p>\n

A product is defective if it does not meet the quality\u00a0requirements\u00a0applicable at the time of placing it on the market\u00a0or if it does not have the\u00a0characteristics\u00a0given by the manufacturer.<\/span><\/p>\n

What is the deadline for enforcing your product warranty claim?<\/b><\/span><\/p>\n

You can claim your product\u00a0warranty within\u00a0two\u00a0years of\u00a0the product being marketed by the manufacturer. Upon expiry of that period, you shall lose this entitlement.<\/span><\/p>\n

Against whom and under what other conditions can you claim your product warranty claim?<\/b><\/span><\/p>\n

You can claim your product warranty only against\u00a0the\u00a0manufacturer or distributor of the movable item. You must\u00a0prove the\u00a0defect of the product if you claim a product warranty.<\/span><\/p>\n

In what cases is the manufacturer (distributor) exempt from product warranty?<\/b><\/span><\/p>\n

The manufacturer (distributor) shall only be exempt from product warranty if\u00a0he can prove that:<\/span><\/p>\n

the product was not manufactured or placed on the market in the course of its business, or\u00a0the defect\u00a0was\u00a0not\u00a0recognized at\u00a0the\u00a0time of placing it on the market,\u00a0or\u00a0the defect in the product results from the application of a legal or regulatory requirement.<\/span><\/p>\n

The manufacturer (distributor) must justify one reason for exemption.<\/span><\/p>\n

Please note that you cannot enforce an Accessory Warranty and Product Warranty\u00a0Claim simultaneously for the same defect. However, if your\u00a0Product\u00a0Warranty Claim is effectively enforced, you may enforce your Accessory\u00a0Warranty Claim against\u00a0the replaced Product or\u00a0part with the manufacturer.<\/span><\/p>\n

Guarantee<\/b><\/span><\/p>\n

When can you claim your warranty?<\/b><\/span><\/p>\n

In accordance with Government Decree 151\/2003 (September 22) on the statutory guarantee for durable products in case of defective performance Seller is obliged to provide a guarantee<\/span><\/p>\n

The law stipulates a guarantee for durable consumer goods (such as technical items,\u00a0tools, machines) and their parts that have a purchase value in\u00a0excess of\u00a0HUF 10 000.<\/span><\/p>\n

What are your rights and within what time limit are you entitled to a guarantee?<\/b><\/span><\/p>\n

Government Decree 151\/2003 (September 22) on the statutory guarantee for durable products stipulates the instances to which a statutory guarantee applies. The\u00a0Seller does not provide a guarantee for Products\u00a0not covered by this scope. The guarantee claim is\u00a0valid during\u00a0the guarantee period. If upon the entitled party\u2019s claim the the guarantor does not comply with the obligation within the deadline, the guarantee shall be enforced in court within three months of the expiry of the deadline even if the guarantee period has expired. Failure to comply with this time limit will result in loss of rights. Otherwise, the\u00a0rules governing the exercise of\u00a0accessory warranty claims\u00a0should apply mutatis mutandis to\u00a0the enforcement of a guarantee claim. The\u00a0guarantee period is one year. Failure to comply with this time limit will result in loss of rights. The guarantee\u00a0period\u00a0begins on the day of product delivery to\u00a0the\u00a0consumer or, in the case of commissioning by the company\u00a0or its agent on the day of commissioning. For\u00a0guarantee claims\u00a0beyond one year,\u00a0please contact the manufacturer.<\/span><\/p>\n

What is the relationship between guarantee and other warranty rights?<\/b><\/span><\/p>\n

The guarantee is in addition to the warranty rights (product and accessory warranty). A fundamental\u00a0difference between the general warranty and the guarantee is that the\u00a0burden of proof is more favorable to\u00a0the\u00a0consumer under\u00a0the guarantee. <\/span><\/p>\n

Under Government Decree 151\/2003\u00a0consumer goods with\u00a0fixed\u00a0wiring, products with a weight exceeding 10 kg and products that cannot be transported on public transportation as a hand luggage, except vehicles, shall be repaired at the place of operation. Where repairs\u00a0cannot be carried out at the place\u00a0of\u00a0operation, disassembly and assembly, as well as\u00a0transportation to and from the repair workshop, shall be provided by the business, in the\u00a0case of a request for\u00a0repair directly by\u00a0the repair service, by the repair service.<\/span><\/p>\n

The seller’s undertaking for the duration of the statutory guarantee shall not include\u00a0terms and conditions that are less favorable to\u00a0the consumer\u00a0than the rights guaranteed by the statutory guarantee. Thereafter (after 1 year), however, the terms of the voluntary guarantee are\u00a0to be determined freely, however, in this case, the guarantee shall not affect the consumer’s\u00a0statutory\u00a0rights,\u00a0including any accessory warranty claims.<\/span><\/p>\n

Request for replacement within three business days<\/b><\/span><\/p>\n

In the case of sales through the\u00a0Webshop, the\u00a0institution of a request for replacement within three business days will also apply. Requests for replacement within three business days are subject to Government Decree 151\/2003.\u00a0(IX. 22.) on\u00a0consumer durables, according to which if within\u00a03 working days a person validates the exchange demand, the seller must\u00a0interpret that the product was defective at the time of sale and you\u00a0must replace\u00a0the product without further\u00a0notice.<\/span><\/p>\n

When is the Seller Released from guarantee?<\/b><\/span><\/p>\n

The Seller shall not be released from its guarantee obligation unless it proves that the\u00a0cause of\u00a0the\u00a0defect occurred after performance.<\/span><\/p>\n
